The short version: be at least 13 (and have a parent or guardian's OK if you are under 18), keep your account to yourself, follow the Community Guidelines, and remember that tournaments are run by their organizers. NXLVL never holds entry fees or prize money. The rest of this page is the full agreement.
1. About these terms
NXLVL is an esports platform for running and joining tournaments, finding teammates, and sharing your games. It is operated by Khaizer D. Noguera, trading as NXLVL, in the Philippines ("NXLVL", "we", "us").
These Terms of Service ("Terms") are an agreement between you and us. By creating an account or using NXLVL you agree to them and to our Privacy Policy. If you do not agree, please do not use NXLVL.
2. Who can use NXLVL
- You must be at least 13 years old.
- If you are under 18, a parent or legal guardian must agree to these Terms for you and is responsible for your use of NXLVL, including any tournament you enter that has an entry fee or a prize.
- You may not use NXLVL if we have closed your account before, or if the law where you live does not allow it.
We may ask you to confirm your age, and we may close an account that does not meet these rules. Organizers may set their own age limits for their events.
3. Your account
- Give accurate details when you sign up, including your date of birth.
- One person, one account. Do not share it, sell it, or use someone else's.
- Keep your password and your email account secure. You are responsible for what happens on your account until you tell us it was compromised at support@nxlvl.online.
- Your username must not impersonate another person, team, organization or brand.
4. How you must behave
You agree to follow the Community Guidelines, which are part of these Terms. In short, you must not:
- harass, threaten, or abuse anyone, or post hateful or sexual content;
- cheat, fix matches, or misrepresent results;
- scam people, fake payment proof, or impersonate others;
- post anything illegal, or anything you do not have the right to share;
- spam, scrape, or automate access to NXLVL, probe it for weaknesses outside our security process, or interfere with how it works;
- misuse the report system, for example by reporting people in bad faith.
5. Your content
You keep ownership of what you post: profile details, posts, comments, messages, images, videos and anything else ("your content").
So that NXLVL can work, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and share your content within NXLVL, and to make technical changes such as resizing images. This licence ends when you delete the content or your account, except for copies others have already shared, records we must keep (see the Privacy Policy), and backups that expire on their own.
You confirm you have the right to post your content and that it follows these Terms. We may remove content that breaks them.
6. Tournaments and organizers
Players, teams and organizations ("organizers") run tournaments, scrimmages and other events on NXLVL. We provide the tools; the organizer runs the event.
- Organizers set the rules: format, schedule, eligibility, entry fee, prizes and refunds. They are responsible for running their event fairly, for the prizes they promise, and for following the laws that apply to it, including rules for minors and for prize competitions.
- NXLVL does not handle money. Entry fees are paid directly to the organizer, using the payment details the organizer provides. We never receive, hold or pay out entry fees or prizes, and we cannot issue refunds.
- Payment proof. If an event asks you to upload proof of payment, it is shared with that event's organizers so they can confirm your entry.
- Disputes about payments, prizes, results or eligibility are between you and the organizer. We are not a party to them, but you can report an organizer or event that breaks these Terms and we will review it.
7. Moderation, suspension and closing your account
We review reports and may warn you, remove content, or suspend or close your account if you break these Terms or put others at risk. Where we can, we will tell you why. If you think we made a mistake, you can appeal: see how to appeal.
You can stop using NXLVL at any time. To close your account and have your personal information deleted, see "Your rights" in the Privacy Policy.
8. NXLVL and other people's rights
The NXLVL name, logo, design and software belong to us. You may not copy or reuse them without permission, except to link to NXLVL or share your own content from it.
Game names, logos and artwork shown on NXLVL belong to their publishers. NXLVL is not affiliated with or endorsed by any game publisher.
If you believe something on NXLVL infringes your copyright, send us a notice as described in copyright notices.
9. Other services
NXLVL links to, or works with, services we do not control: sign-in providers, game publishers' image servers, payment channels organizers ask you to use, and sites people link to. Your use of those services is governed by their own terms, and we are not responsible for them.
10. No guarantees
We work hard to keep NXLVL running and safe, but we provide it "as is" and "as available". To the extent the law allows, we make no promises that it will always be available, error-free, or suitable for a particular purpose, or that any event, organizer or player on it will behave as they say. Some features may be labelled as beta and may change or be removed.
11. Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential losses (such as lost profits, lost prizes, or lost data), or for anything organizers or other users do. Our total liability to you for any claim about NXLVL is limited to the greater of the amount you paid us in the 12 months before the claim, or PHP 1,000.
Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or for harm caused by gross negligence.
12. Your responsibility to us
If someone makes a claim against us because of your content, an event you organized, or your breach of these Terms, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines. Before going to court, please contact us at support@nxlvl.online so we can try to sort it out. If we cannot, disputes will be heard by the competent courts of the Philippines, unless the law where you live gives you the right to bring a claim there.
14. Changes to these terms
We may update these Terms as NXLVL changes. When we make an important change, we will update the effective date above and ask you to accept the new version the next time you use NXLVL. If you do not accept it, you can close your account.
